1. Scope
These Terms of Service apply to the use of the qr9 service (hereinafter "Service"),
a service provided by Sichtwerk AG, Gaiserstrasse 16, 9050 Appenzell, Switzerland (hereinafter "Provider").
By registering, you accept these Terms of Service.
2. Description of Services
qr9 enables the creation, management and tracking of QR codes.
The Service is offered in various subscription tiers (Free, Personal, Business).
The exact scope of services is defined by the current product description on the website.
3. Registration & Account
- You must provide accurate information.
- You are responsible for the security of your account.
- An account is non-transferable.
- We reserve the right to suspend accounts in the event of misuse.
4. Pricing, Payment & Renewal
- Prices are stated in Swiss francs (CHF) and include any applicable statutory VAT.
- Paid subscriptions are billed in advance via our payment processor Stripe.
- The billing interval selected at checkout applies (currently monthly; further intervals such as quarterly or annual may be offered).
- Automatic renewal: At the end of each billing period, the subscription renews automatically for a further period of the same length, unless you cancel beforehand (see Section 5). Your stored payment method will be charged without further confirmation.
- Price changes are announced at least 30 days in advance by email and take effect from the next billing period. If you do not agree, you may cancel before they take effect.
- A free trial period may be granted upon initial registration. If not cancelled before it ends, it automatically converts into a paid subscription.
- In the event of payment default, we are entitled to restrict paid features or downgrade the account to the Free plan (see Section 6).
5. Term & Cancellation
- There is no minimum contract term. Monthly subscriptions are cancellable monthly — you may cancel at any time, effective at the end of the current billing period. For longer intervals (e.g. an annual plan), cancellation takes effect at the end of the respective paid period.
- No additional notice period applies: cancellation becomes effective at the end of the current, already-paid period and prevents automatic renewal.
- Cancellation is available through the Stripe customer portal in your account's billing overview or by email to us. You will receive a confirmation.
- The full feature set remains available until the end of the paid period; afterwards the account is automatically downgraded to the Free plan.
- Amounts already paid are non-refundable, including on a pro-rata basis.
- Before cancelling, we recommend exporting your redirect configuration (see Export feature) and backing up your QR targets.
6. Dynamic QR Codes & Redirect Operation After Termination
Dynamic QR codes do not encode the target content directly but a qr9 redirect URL that forwards to the destination you have configured at runtime.
Redirect operation works only while your account is active and the relevant plan conditions (e.g. the permitted number of QR codes) are met.
- Following cancellation, downgrade, payment default, account deletion or discontinuation of the Service, the continued operation of dynamic redirects is not guaranteed and may be stopped or deactivated at any time.
- QR codes that have already been printed or distributed may thereby become unusable. You bear the risk for this.
- If the number of your QR codes exceeds the plan limit after a downgrade, we may suspend redirect operation for the excess codes.
- Static QR codes are not affected, as they contain the target directly and function without our Service.
- Any continuation of redirects on the Free plan is voluntary and without entitlement or guarantee.
7. Acceptable Use
You agree not to use the Service for the following purposes:
- Distribution of malware, phishing or fraudulent content
- Violations of applicable law
- Mass automated use without prior permission
- Resale of the Service without a written agreement
In the event of violations, we reserve the right to suspend or delete accounts without prior notice.
8. Disclaimer of Liability
The Service is provided "as is" and "as available", without any warranty — either express or implied.
- We do not guarantee uninterrupted, error-free or secure availability of the Service.
- We accept no liability for the functionality of QR codes, redirects or scan tracking.
- We are not liable for damages arising from the failure, malfunction or unavailability of the Service.
- We are not liable for damages caused by printed QR codes that cease to function due to technical changes or discontinuation of the Service.
- Use of the export feature (.htaccess / Nginx) is at your own risk. We accept no liability for correct operation on third-party servers.
The Provider's liability is in any case limited to the amount
you have paid for the Service in the preceding 12 months.
Excluded are damages caused by wilful misconduct or gross negligence.
9. Availability
We strive for high availability but do not guarantee it.
Maintenance, technical issues or force majeure may lead to outages.
There is no entitlement to availability.
10. Intellectual Property
The QR codes you create and the content you upload remain your property.
You grant us the right to process and store them in order to provide the Service.
The software, design and the qr9 brand are the property of the Provider.
11. Custom Domains
When using custom domains, you are responsible for DNS configuration and domain ownership.
We provide the technical infrastructure for redirect operation but accept
no responsibility for DNS issues, certificate errors or domain disputes.
12. Changes to Terms of Service
We reserve the right to amend these Terms of Service at any time.
Material changes will be communicated by email.
If you do not accept the changes, you may cancel your account.
Continued use after the changes take effect constitutes acceptance.
13. Governing Law & Jurisdiction
Swiss law applies. The place of jurisdiction is Appenzell, Switzerland.
